OVERVIEW

1. This website is operated by Herbal Fusion Limited (“Herbal Fusion”). Throughout our website, the terms “we”, “us” and “our” refers to Herbal Fusion.

2. Your use of our website and the purchase of our products will represent your agreement to be bound by these Terms & Conditions (as amended from time to time) (“Terms”). You can review an up-to-date version of our Terms at any time on this website. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to our website following the posting of any changes constitutes acceptance of those changes.

PRODUCTS

3. Our online store is hosted on Shopify Inc (“Shopify”), being an online e-commerce platform that allows us to sell our products to you.

4. We endeavour to ensure that our product list is current but accept no liability in the event that a product on our website is not available for purchase. We reserve the right to discontinue certain products without notice at any time.

5. All prices on our website are in New Zealand Dollars (NZD) and are inclusive of GST. We reserve the right to amend our prices at any stage.

RETURNS & EXCHANGES

6. We have a 15-day return policy, meaning that you have 15 days after receiving your item to request a return or exchange.

7. To be eligible for a return or exchange, your item must be in the same condition that you received it, unused and in its original packaging. We also require the receipt or proof of purchase.

8. You may request to return or exchange your item by contacting us at info@herbalfusion.co.nz. We will then send you instructions as to how and where to send your package. Please note that items sent back to us without first requesting a return or exchange will not be accepted. 

Damage or issues

9. Please inspect your order upon receipt and contact us immediately if the item is defective, damaged or if you have received the wrong item so that we can provide you with a remedy.

Refunds

10. Our products come with the consumer guarantees found in the Consumer Guarantees Act (“the Act”) which cannot be excluded. If your item does not comply with the consumer guarantees, we will provide a remedy in accordance with the Act.

11. In the event that you qualify for a refund, your payment will be refunded to your original payment method. Any refund will exclude shipping costs (if applicable) and the cost incurred in returning the item to us.

SHIPPING POLICY

12. Enjoy FREE shipping on all New Zealand orders over $100.00. Orders for less than $100.00 will incur a $6.00 shipping fee for urban addresses or $11.00 for rural zones. 

13. Once your order has been dispatched, you will receive notification from the delivery company, together with tracking details. In the event that you have queries or issues regarding the delivery of your order, please contact the delivery company in the first instance. All risk of loss or damage to the goods passes to you upon your order being dispatched.

14. We aim to fulfil orders within 3 working days, with delivery timeframes being between 3-5 working days from the date of fulfilment of your order. Please note that this delivery timeframe is a guideline only and is subject to change.

LIMITATION OF LIABILITY

15. All products should be used strictly in accordance with the instructions, precautions and guidelines provided. You must ensure that you have checked the ingredients within our products and that you have undertaken patch testing to avoid any allergic reactions.

16. Please consult your physician or health care practitioner regarding the use of any of our products or the information received from our website prior to using or relying on them. Herbal Fusion does not represent itself as a physician, nor is this implied.

17. We do not provide any warranty (either express or implied), including (but not limited to) implied warranties as to fitness of our products for a particular purpose. To the extent permitted by law, any condition or warranty which would otherwise be implied into these Terms is excluded.

18. To the extent permitted by law, our liability for breach of an implied condition or warranty is limited to the supply of the goods again or payment of the cost of having those goods supplied again. We accept no liability for any consequential loss suffered by you from the use of our products (including in the event that you suffer from an allergic reaction from use of our products).

INTELLECTUAL PROPERTY RIGHTS

19. The copyright to all content on this website belongs to us. All trademarks (including ‘Herbal Fusion’), brands and logos generally identified with the symbol ‘TM’ are owned by us. Your use of our website does not authorise you to use those marks without our prior written permission. 

PRIVACY

20. While we endeavour to take due care with any information that you provide to us, we cannot ensure the security of any such information.

21. Your data is stored through Shopify's data storage, databases, and the general Shopify application.

JURISDICTION

22. These Terms are governed by the laws of New Zealand. Any claim arising out of these Terms will be subject to the jurisdiction of the New Zealand Courts. 

SEVERABILITY

23. In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

ENTIRE AGREEMENT

24. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

25. These Terms and any policies or operating rules posted by us on this website constitutes the entire agreement and understanding between you and us and governs your use of our products.
